Velocity Terms & Conditions

1. Our Service
 
Velocity by Black Rocks Marketing provides custom website design, development, framework configuration and ongoing monthly cloud hosting services. By starting your monthly subscription, you explicitly agree to be bound by these Terms and Conditions.
 
2. Payment Delay and Building Window
 
We collect your payment card details today to secure your layout slot, but we will charge you zero money upfront. We will immediately begin shaping your website layout around your data on a private link and we aim to get your staging link live within 7 days. The quicker you complete and return our onboarding data form, the quicker our team can launch your framework. On day eight (8), your card will be automatically charged for your chosen monthly subscription plan.
 
3. Cancellation Policy
 
No Long-Term Contracts: All Velocity plans operate as rolling monthly subscriptions with no long-term commitments. You can cancel your subscription at any time.
 
How to Cancel: To cancel your subscription, you must log into your secure billing portal and process the cancellation, or send a written email request to our support team at least 3 business days before your next automated billing date.
 
No Part-Month Refunds: If you cancel mid-month, your website will remain online until the end of your current paid billing cycle. We do not offer partial or pro-rated refunds for unused days in a billing month.
 
Post-Cancellation Deactivation: Once your paid billing cycle ends, your automated website hosting, platform configurations and system access will be deactivated and your website will go offline.
 
Intellectual Property & Design Ownership: The data-driven layouts, code structures, graphics and configurations built under the Velocity platform are the exclusive intellectual property of Black Rocks Marketing. Because there are zero upfront design fees, you are paying for an ongoing infrastructure service, not buying a standalone software asset. If you cancel your subscription, you do not own the website design and it cannot be transferred, migrated, copied or exported to another hosting provider or server.
 
4. Design Approval and Changes
 
We work fast to build your website using the branding assets, copy and logo information you provide. It is your sole responsibility to review the private staging link we send you. Your automated monthly billing will still commence on day eight (8) even if you have not checked or approved your website layout yet.
 
5. Privacy Policy & Consent Banner Disclaimer

No Legal Liability: If you choose to use our standard boilerplate privacy policy, cookie consent banners, or integrated third-party compliance tools (including the free tier of Usercentrics) on your website, you do so entirely at your own risk. We are website creators and technical integrators, not legal professionals. We take absolutely no responsibility for the legal accuracy, regulatory compliance or regional validity of those policies or consent tools for your specific business. It is your sole responsibility to have a legal professional review them.

Traffic Limits & Automatic Upgrades: Free-tier cookie consent structures (such as Usercentrics) include fixed monthly traffic allowances (typically up to 20,000 pageviews per month). If your website traffic exceeds this allowance, a paid premium upgrade is required to maintain legal compliance and keep the banner active. Because we manage your platform infrastructure, we will automatically upgrade the tool on your behalf to prevent service disruption. You explicitly agree that we reserve the right to increase your monthly subscription fee or issue a separate recurring charge to pass on the direct cost of this premium compliance license plus a standard administration fee. We are not liable for any compliance failures or banner deactivations if you refuse to accept a required traffic upgrade.
 
6. Service Interruptions and Search Indexing

We use premium, enterprise-grade cloud hosting platforms to keep your web presence live. We are not held responsible or legally liable for any minor technical anomalies, system updates, third-party API issues or temporary internet downtime outside of our direct, operational control.

Search Engine Indexing: While we submit your XML sitemap to Google Search Console upon launch as part of our setup configuration, we have zero direct control over Google’s automated crawling algorithms, indexing timelines or keyword ranking fluctuations. We guarantee the technical deployment of your site structure, but we accept no liability for how search engines rank or display your website over time.

 
7. Domain Names (Website Addresses)
 
Launch Framework: You must supply your own domain name. You will need to log into your personal domain registrar and point the nameservers to our platform. We will send you simple, step-by-step instructions on how to do this.
 
Growth and Market Leader Plans: We include a standard domain name registration (such as a standard .com) for your website. If you already own a domain name, you are welcome to use it instead. If you use your own pre-owned domain, you must point the nameservers to our platform using our instructions.
 
Premium Domains Excluded: We only cover standard domain names. If the website name you want is classified as a "premium domain" (a high-cost, aftermarket or rare name sold at an inflated price by registrars), you must purchase it yourself entirely.
 
Domain Ownership and Setup: If we provide the domain, we will register your standard domain name through GoDaddy. You must set up your own free, personal GoDaddy account. Once created, we will securely transfer the domain completely into your account. Once transferred, the domain is entirely under your control. It is your sole responsibility to manage its renewal fees, keep your GoDaddy billing details updated, and ensure it does not expire. You may grant our agency access to manage it if you want.
 
Growth Plan Renewal: For Growth plans where we register the domain, the domain is free for the first year. After the first year, you are entirely responsible for the standard yearly renewal cost of that domain name inside your registrar account.
 
Project Delays: If you take a long time to choose an available domain name or update your nameservers, your automated monthly billing will still start on day eight (8) as planned.
 
8. Monthly Care Tokens
 
Package Allowances: Your monthly plan includes a set number of Care Tokens each month depending entirely on your chosen tier:

• Launch Framework: 0 Care Tokens per month. All structural updates, text adjustments, and modifications are fully chargeable as needed.

• Growth Lab: 1 Care Token per month.

• Market Leader: 8 Care Tokens per month.

What a Token is Worth: One Care Token is worth approximately 15–20 minutes of dedicated design or text work. You can use your tokens for small layout adjustments, text changes, or swapping out images.
 
No Roll-Over: Care Tokens expire at the end of each billing month if you do not use them. They do not roll over to the next month.
 
Extra Work: If you require major structural changes, brand shifts, or extra development work done after using your monthly token allowance (or if you are on the Launch Framework plan), we will issue a separate project quote for the additional cost before work begins.
 
9. Failed Payments and Service Suspension
 
Automatic Retries: If your automated monthly subscription payment fails, Stripe will automatically re-attempt the charge based on our system schedules.
 
Grace Period & Deactivation: If a subscription payment is not successfully cleared within three (3) days of its due date, your website and platform access will be automatically suspended and taken offline.
 
Reactivation Fee: We charge a flat €25 / £25 administration fee to reactivate a suspended website once your billing details are successfully updated. We are not liable for any loss of business, digital traffic, search engine rankings or leads while your site is offline due to failed payments.
 
10. Acceptable Use and Content
 
Content Ownership: You retain all ownership, copyrights and responsibilities for the text, images and logos you provide for the website. You guarantee that you own the explicit rights to all materials you submit to us.

Immediate Termination: We reserve the right to immediately terminate your subscription, cancel your service and take your website offline without a refund if you use our framework to host or display content that is illegal, fraudulent, defamatory, malicious, pornographic or explicitly infringes on third-party intellectual property rights.

 

11. Price Adjustments and Modifications 

 

Black Rocks Marketing reserves the right to adjust the monthly subscription fees for any services, including the Velocity frameworks, to reflect changes in infrastructure costs, inflation or service enhancements. We will provide you with at least 30 days’ written notice via email prior to any price adjustment taking effect. Continued use of the service after the 30-day notice period constitutes acceptance of the new pricing structure. If you do not agree to the price adjustment, you retain the right to cancel your subscription prior to the effective date of the price increase.
